Advertiser Terms and Conditions

We (“ThatRecruit​”, “We​” or “Us​”) are an independent website operated by That Recruit.

The following terms and conditions (“Terms”​ ) are for clients or potential clients (“Client​”, “You​” and “Your​”) wishing to use this platform to advertise. These terms set out the relationship between us and you.

By using our services, you are deemed to have accepted these Terms which form the basis of all transactions between us and you. If you do not agree to these Terms, please do not engage in our services.

1.USING THATRECRUIT

1.1. ThatRecruit offers its clients the ability to advertise their vacancy over a number of different internet based platforms.

1.2. Clients are required to create an account to use the Service. Each Client company shall be entitled to one account.

1.3. ThatRecruit do not charge a registration fee, or commission on the placement for a vacancy advertised through us. Instead, ThatRecruit charges as a flat fee in accordance with clause 3 below.

1.4. A ThatRecruit account allows you to view your advertisement as well as any potential applications received (“Account​”)

1.5. You shall be required to provide a username and password. It is your responsibility to ensure that all security details are kept confidential. ThatRecruit cannot be held responsible for misuse of information misplaced by the Client or their representatives. Users shall be responsible for activity made from their Account.

1.6. ThatRecruit shall store the information provided by you, however, we shall not use, sell or make public such information without your consent.

1.7. Advertisements are placed through your Account where you shall be able to upload your advertisement content with the following two options;

1.7.1. Approve Status​; provides instruction to ThatRecruit that any changes or amendments made to the Client’s proposed advertisement content, should be approved by the Client prior to being uploaded.

1.7.2. No Approval Status​; provides instruction to ThatRecruit that any amendments and/or changes made can be uploaded without the need for your consent.

1.7.3. No Changes; ​provides instruction to ThatRecruit that no amendments and/or changes are to be made. This will be reviewed and subject to suitability checks.

2.ADVERTISEMENT CONTENT AND UPLOAD

2.1. Clients can provide the content for upload without guidance or assistance from ThatRecruit. In such cases, ThatRecruit cannot be held liable or responsible for errors or erroneous content. Alternatively, ThatRecruit can provide the content for the advert on behalf of the Client.

2.2. Where you decide to provide your own content for advertisements, the advertisement should be in clear English, honest and free from any discriminatory, racial or sexist content and the following information should be included as a minimum;

2.3. Once confirmed, advertisement content shall be uploaded by ThatRecruit to a variety of online platforms specified or job placement. Where appropriate, ThatRecruit shall upload advertisements to specialist platforms as well as general ones.

2.4. Advertisements have a life span of 28-days after which time the advertisement is automatically removed from all sources.

2.5. Where a vacancy is filled prior to the 28-day life span of the advertisement, you may inform us of placement and we shall ensure that the advertisement is removed.

3.FEES

3.1. ThatRecruit charges a flat fee of £139 + VAT per advertisement placed (for bulk purchase rates please refer to thatrecriut.com/pricing). We do not charge commission on placements of applicants and do not charge any additional fees whatsoever.

3.2. Our Fee is non-refundable and non-cancellable except for where we are in material breach of these terms.

3.3. Fees should be paid upfront prior to the upload of an advertisement. ThatRecruit shall issue an invoice to you upon acceptance of your request for our services and upload shall take place upon receipt of cleared funds.

3.4. ThatRecruit reserve the right to use our discretion when uploading advertisements prior to the clearance of Fees. Where Fees do not clear, or an advertisement is placed, prior to payment, ThatRecruit may remove the advertisement and charge you the full amount outstanding. We reserve the right to run a company credit check on your business and related companies.

3.5. Payment of Fees should be made in pounds sterling (GBP), by bank transfer to the details provided on your invoice. Copy invoices can be provided by contacting us and quoting the invoice details and your account details.

3.6. No deduction or set off should be made on any Fees outstanding. Overdue fees shall incur interest in accordance with the Commercial Debts (Late Payment of Interest) Act 1998. 3.7. Fees are exclusive of VAT or other applicable taxes.

4.USER OBLIGATIONS

4.1. Client’s warrant to provide their full and correct details and shall ensure that details are updated at all times.

4.2. Uploaded content must be free from immoral, illegal or abusive content. ThatRecruit endeavour to review all advertisements prior to upload. However, in the event that content is missed, responsibility for such content shall belong to the Client.

4.3. Users understand and accept that whilst ThatRecruit do not use personal information for any advertising or marketing purposes, all data is stored on the platform and is protected by our Data Protection and Privacy Policies.

4.4. Client’s understand and accept that they appoint the services of the applicants at their own risk and understand that ThatRecruit accept no responsibility or liability for the outcome of such service or placement.

4.5. ThatRecruit provide a space for Clients to advertise but do not perform background checks or verify the applicants. Clients accept and understand that any applicant they contact or engage with is a separate entity to ThatRecruit and are in no way related to ThatRecruit.

4.6. Clients may receive multiple applications through various platforms. ThatRecruit advertise the vacancies on a number of different platforms and as such, cannot guarantee the number of suitable applicants.

4.7. ThatRecruit do not contact applicants on behalf of the Client, or Client’s on behalf of the applicant. As such, ThatRecruit recommends that Clients log into their account regularly to review applicant activity.

4.8. Where a placement has not been filled prior to the 28-day life span of the advertisement, Clients are able to renew the advertisement by contacting ThatRecruit.

5.THATRECRUIT OBLIGATIONS

5.1. We may change these Terms from time to time. We will give you notice of any changes by posting those changes on Our website. We will not vary any terms which you previously agreed whilst using this Service. However, any amended Terms will apply to your use of this website from the date they are posted and if you do not agree with the amended Terms, you are entitled to stop using this website at that time.

5.2. The relationship between ThatRecruit and you exist only with us as an introductory platform and you as a Client.

5.3. ThatRecruit shall have no interaction with the applicants, or be party to any communication between the you and the applicant(s).

5.4. These Terms and Conditions and our correspondence with you will be communicated in the English language.

6.DISPUTES

6.1. Disputes between the you and an applicant should be dealt with directly between the parties. ThatRecruit do not have any responsibility or liability to the parties to intervene in any dispute arising from their communication or contact.

7.ACCOUNTABILITY

7.1. ThatRecruit do not accept any liability or responsibility for the organising or distribution of payments in lieu of work completed and any dispute between the parties in relation to payment is solely between the Client and their chosen applicant(s).

7.2. ThatRecruit does not accept any responsibility for the content of jobs, tasks or projects advertised, nor for the content of the profiles registered by Clients.

7.3. ThatRecruit cannot guarantee the quality of the projects, jobs or tasks advertised, the legitimacy of the applicant or account for you or the vacancy or task in any way whatsoever.

8.RESPONSIBILITY FOR CONTENT

8.1. We use our best endeavours to provide you with a quality service and virus free website. However, we are not responsible for computer viruses or other computer related problems you suffer as a result of using this website, which are beyond our reasonable control. We recommend that you use your own appropriate virus checking software.

8.2. We do not prevent or exclude our responsibility to you for death or personal injury resulting from our negligence.

8.3. Neither We, nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose.

8.4. Information provided on this website may contain inaccuracies or errors and we accept no liability whatsoever to the fullest extent permitted by law, for any such inaccuracies or errors.

8.5. Whilst we make every effort to ensure that accurate information is uploaded to the site and third party sites, we cannot guarantee this.

9.TERMINATION AND CANCELLATION

9.1. We may terminate an advertisement and your account, at any time without notice, at our discretion in the event that;

9.1.1. you breach these Terms, and the breach continues for a period of more than 5 working days after you have received notice from us to rectify the breach;

9.1.2. fail to pay sums outstanding and due to us;

9.1.3. You are found to be, in our reasonable opinion, misusing the service, acting immorally, illegally or in competition, whether directly or indirectly, with ThatRecruit or are acting in such a way as to cause damage to ThatRecruit’s name, reputation or service.

10.ACCESSING OUR SITE

10.1. Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

10.2. You agree that you shall not do anything that affects the integrity or security of this website or causes or may cause harm, damage or unreasonable inconvenience to other users of this website or us.

10.3. If you breach any of the clauses set out at above, We may take such action as we deem appropriate, including denying you access to this website, bringing legal proceedings against you and disclosing such information to appropriate legal and/or regulatory bodies.

10.4 By registering with us, you're agreeing we may contact you from time to time letting you know about our products and services. We will never sell your data.

11.INTELLECTUAL PROPERTY RIGHTS

11.1. We are the owners or the licensees of all intellectual property rights in and on our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

11.2. You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.

11.3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

11.4. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

11.5. You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

11.6. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

12.ADVERTISING ON OUR SITE

12.1. ThatRecruit may, from time to time, advertise other companies on the website. These advertisements are independent of ThatRecruit and ThatRecruit do not necessarily agree with, promote or condone the content of the advertisements.

12.2. ThatRecruit do not accept any responsibility or liability for any content or sites which you are directed to as a result of clicking on an advertisement shown on the website or for any third party sites that you may be referred to.

12.3. For each advertising credit purchased the client will be eligible to have one succesful candidate reference checked by ThatRecruit free of charge. The reference check will involve contacting the candidates previous employer and requesting a reference regarding their employment including confirmation of dates. This is limited to one candidate per advert and this is available from 01/03/17 onwards.

13.OUR SITE CHANGES REGULARLY

13.1. We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

14.OUR LIABILITY

14.1. The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

14.1.1. All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

14.1.2. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

14.2. for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

14.3. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

14.4. Once you have contacted a service provider and have employed their services you are bound by their independent terms and conditions which are in no way whatsoever connected to ThatRecruit.
